Sometimes, people say things they don’t really mean. It could be a bad remark, a white lie, a careless comment, or just a misunderstanding that gets out of hand. But if those words result in physical violence, it’s a serious matter.
You will need the help of an experienced criminal defense lawyer in New York.
Former Prosecutor in Long Island, Olivier E. Roche, Esq.
Before opening my own law office, I served as a prosecutor wherein I was in charge of prosecuting felony and misdemeanor violent crimes of all types. Today, I use my hands-on experience and thorough understanding of both federal and state laws as leverage to help clients facing violent crime charges, including:
- Simple Assault (1st, 2nd, 3rd degree)
- Felony Assault
- Misdemeanor
- Vehicular
- Gang
- Homicide
- Strangulation
- Criminal Obstruction Breathing / Blood Circulation
Aggressive Representation, Specifically in Assault Cases
The charge may carry a long prison sentence, but it could be plead down to reduced or even dropped charges, especially if the accuser only fabricated the story.
In the case of assault, the basic requirement for a conviction in New York is that the defendant caused physical injury. A number of factors also come into play to determine the charge:
- Extent of injuries (will determine the level of the assault, whether misdemeanor or felony)
- The victim should suffer at least some physical, not mental, injury or pain. NY law defines physical injury as the impairment of physical condition or an injury causing substantial pain. If it’s a serious physical injury, it should create a substantial risk of death or actually causes death, ill health, loss or impairment of an organ, or long-term disfigurement.
- Relationship between the parties involved
- Whether a weapon was used
- The motive
- Mental culpability of the accused to know the degree of his or her offense
If the prosecution doesn’t have enough evidence to convict, I won’t hesitate to take your case to trial to seek a not-guilty verdict on your behalf. If they have strong or solid evidence, I’ll find a way to provide a vigorous defense by conducting a thorough investigation of the facts of the case. I’ll leave no stone unturned, so you can achieve the best possible outcome.
Violent crimes are usually difficult to defend, even for the best attorneys. This being the case, you don’t want to bargain shop for law firms, or put your entire future in the hands of someone fresh out of law school. Let me handle your case.
