Nothing matters more than making sure your children are happy and healthy, and that you maintain a positive relationship with them. But sometimes each parent has a different idea about parenting and decision-making.

When a disagreement or child custody issues arise, you need a family law attorney that can help you during such an emotional and stressful time. Olivier E. Roche, Esq. represents clients throughout New York.

My primary goal is to protect your rights throughout the process, and to resolve areas of dispute as soon as possible.

Types of Child Custody in New York

There are three types of child custody agreements:

  • Physical Custody – addresses where the child would live
  • Full Custody – addresses decision-making issues when it comes to education, health, etc.
  • Joint or Shared Custody – in this arrangement, both parents share the decision-making power when raising the child

In shared custody situations, I will help you determine the arrangement that makes the most sense for your child and for you.

Determining Who Gets Custody

Either parent has no prima facie (i.e., a fact presumed to be true unless proven otherwise) right to custody. The sole criterion is the best interest of the child.

In addition, the Family Court will focus on nine factors when determining who gets custody:

  1. Parental guidance
  2. Home environment
  3. Financial status
  4. Individual needs of the child
  5. Desires of the child
  6. Ability of the parent to provide for the child’s development
  7. Age and maturity of the child
  8. Potential for influence on the child
  9. Siblings

Winning a custody battle starts with knowing how to fight.

Let Olivier E. Roche, Esq. help you understand how the process works, guide you toward a favorable outcome, and win your case.
