Your Rights as an Accused
As an accused, the United States Constitution and New York Constitution guarantees your rights. These include:
- Right to remain silent
- Right against self-incrimination
- Right to an attorney
- Right to a speedy, fair, and public trial
- Right to a reasonable bail
- Right to be informed of the charges
- Right to confront any witnesses testifying against you
You’re also presumed innocent until proven guilty. The prosecutor must prove beyond reasonable doubt that you committed the crime or violation, and you have no obligation to prove your innocence.
The Arrest Process and What to Expect
The police must follow certain steps during and after the arrest. They will handcuff you and you will first be taken to the precinct, where they will interview you and ask for basic information. Once you’ve been fingerprinted you will be taken for booking and processing for arraignment.
Take note that the police may take all of your personal belongings.
Once booked, the case is provided to the prosecutor’s office whether local or federal to determine what charges should be filed. The next step is the arraignment, where the charges will be read to you and you’ll be asked whether you plead guilty or not guilty.
