New York Penalties for Methamphetamine Possession

• Possessing less than 1/2 ounce of methamphetamine or meth mixture (criminal possession in the 7th degree, Class A misdemeanor) – up to one year in jail
• Possessing 1/2 ounce or more of meth or a mixture containing it (4th degree, Class C felony) – 1 to 5 1.2 years in prison; two-time offenders may face 8 years, and a previous violent offender could face 9 years of jail time
• Possessing 2 ounces or more of meth or a mixture containing meth (2nd degree, Class A-II felony) – 3 to 10 years in prison; second time offenders may get 14 years of jail time, while a previous violent offender could face 17 years

Selling or distributing methamphetamine is a different story. You could be arrested for and charged with felony criminal sale of a controlled substance.
