Sex crimes are a serious issue in New York, with the number of reported cases rising significantly over the past few years. As a result, prosecutors are aggressively seeking to convict those who have been accused of sex crimes.
What are Sex Crimes?
A sex crime could be any of the following:
- Sexual Misconduct- engaging in sexual intercourse, oral sex, or anal sex without consent; engaging in sexual conduct with a corpse or an animal
- Criminal Sexual Acts- engaging in sexual conduct with a person who cannot provide consent
- Forcible Touching- touching, squeezing, pinching, or grabbing another person’s private parts without their consent
- Sexual Abuse- touching sexually or inserting an object into the victim’s body without consent; aggravated if the victim is a minor or is physically helpless
- Predatory Sexual Assault- allegedly committing rape, sexual abuse, or sexual conduct against a child; either injured the victim, used or threatened to use a weapon, or has a previous sex crime-related conviction
- Rape- sexual intercourse without consent
- Course of Sexual Conduct Against a Child
- Obscenity
In its basic definition, a sex crime must have the element of “lack of consent”. The victim could be forced, or could be incapable of consent. Note that sex crimes can be easily charged in clusters – for instance, sex misconduct with sexual assault, plus rape and regular assault.
Defending Against Sex Crimes with Olivier E. Roche, Esq.
In defending against a sex-related charge in a criminal trial, note that presumption of innocence is your legal right. This means the burden of proof is not on you – it’s on the prosecution, who needs to collect and present enough compelling evidence to find you guilty of the crime beyond a reasonable doubt.
These cases are difficult to deal with, but as a former prosecutor in New York, I don’t shy away from these types of cases. I’ll look into the nature of the relationship between you and the victim, how long it took to report the crime, and whether there was an outcry witness.
As a former prosecutor in New York, I believe my clients deserve compassionate legal defense – no matter how serious or complex the allegations are. I can handle a range of sex-related misdemeanor and felony charges, and am proud to serve the residents of New York.
