Many truck-related accidents are a result of the negligence of the truck’s owner or operator.

I understand that negligence is negligence, regardless of whose fault it was. Either way, I provide professional legal representation and fight for your rightful compensation if you have obtained personal injuries from a truck-related accident.

Requirements of New York Truck Drivers

A commercial driver’s license is a New York state requirement for all individuals, 18 years old and above, who drive commercial motor vehicles within the state. The license, though, is not a requirement for all large vehicles. The exemptions are the following:

  • Operators of large vehicles for personal or family recreation
  • Operators of military vehicles
  • Operators of farm vehicles
  • Operators of emergency vehicles

Furthermore, federal law requires New York truck drivers to have regular certification that they are physically and mentally fit to operate the large vehicle. They must meet strict health criteria. For instance, they cannot have a history of conditions such as diabetes, cardiovascular complications, and high blood pressure. They must also have 20/40 vision, at the least, and must not require a hearing aid.

Having a commercial license does not just prevent New York truck operators from going to jail or incurring a fine. It is also proof of a truck operator’s capabilities, thus potentially minimizing truck-related accidents.

Violations of New York’s Transportation Law

Truck-related accidents may also be a result of violations of New York’s transportation laws. These violations include, but are not limited to, the following:

  • Operating the vehicle with faulty brakes and safety apparatus
  • Driving While Intoxicated (DWI)
  • Driving While Ability Impaired (DWAI) by Alcohol, Drugs, or a Combination

On a related note, some truck operators might have been driving under other improper conditions (i.e. drowsiness, fatigue), leading to the accident.

Such conditions constitute negligence on their part, resulting in your personal injury. According to the New York statute of limitation, you may file a personal injury case within three years of the date of the incident.

I will be with you from the filing to the closing of your truck accident lawsuit. I will provide professional representation with a personal touch, enabling you to get the compensation you deserve.
