Xanax is a medication for relieving chemical imbalances in the brain. It can treat anxiety, panic attacks, and depression, and works by blocking the transmission of the chemicals in the brain. It is administered in pill form in a range of shapes and colors.
A Highly Addictive Drug
The problem is, you cannot legally obtain the drug in New York without a prescription from a medical doctor. That’s because Xanax is the brand name for alprazolam, a type of benzodiazepine. Benzodiazepines act on the brain by producing a calming or tranquilizing effect and provide rapid symptom relief, making them highly addictive.
Possession of Xanax without a prescription, therefore, has become a criminal charge in New York.
If you’ve been charged, I can be your defense counsel. Armed with in-depth knowledge of drug possession cases, I can fight for your rights, devise a strong defense strategy, and help you get a desirable result.
Requirements for Conviction
The Prosecutor or District Attorney must prove the following elements before you can be convicted:
- Knowledge – possessing Xanax is a crime if the person doesn’t have a prescription, and knowingly and intentionally has control of the drug
- Possession – the person has personal control over the drug, which means they actually have it in their pocket or in personal custody without prescription
- Shared possession – the person has at least partial control over the drug; for example, two people may each be convicted if they share an apartment in which the police found unprescribed Xanax
Penalties for Xanax Possession
Many people mistakenly think that because Xanax can be legally obtained, being charged with possessing it is less serious than an arrest for possession of cocaine and other types of controlled substances. The truth is, this drug is highly regulated and carries stiff penalties when used without a valid prescription.
The severity of the charge depends on the amount you have.
